Recently, California passed Assembly Bill 2159, allowing Homeowners Associations (HOAs) to implement electronic voting for various types of decisions, including board elections and amendments to governing documents.
This law, effective January 2025, enables HOAs to adopt election rules that allow votes to be cast electronically without requiring prior approval from the membership. However, residents can still opt for traditional paper ballots if they prefer, creating a flexible "two-track" system where members can choose their preferred method of voting.
The adoption of electronic voting is expected to transform how community decisions are made, making the process more accessible and engaging for homeowners. By offering both electronic and traditional voting options, HOAs can cater to different member preferences while still benefiting from the increased participation and efficiency that electronic voting provides.
The bill also introduces strict transparency measures to ensure fairness.
